A Review of Fiqh on Property, Child Custody, and Guardianship in Marriage

The regulation of marital property, child custody (hadhanah), and guardianship (wilayah) constitutes a fundamental component of Islamic family law in Indonesia, as codified in the Compilation of Islamic Law (KHI). Nevertheless, contemporary socio-legal developments have generated interpretative challenges concerning the implementation of these provisions in balancing legal certainty, justice, and public welfare. This study aims to analyze the normative framework governing marital property, child custody, and guardianship within the KHI by examining its conformity with Islamic legal principles and its relevance to contemporary legal needs. The research employed a normative juridical approach using library research methods. Data were collected from primary legal materials, including the Compilation of Islamic Law, Marriage Law, judicial decisions, and classical and contemporary Islamic legal literature, and were analyzed through qualitative content analysis and prescriptive legal interpretation. The findings indicate that the KHI has successfully integrated classical Islamic jurisprudence with Indonesia’s positive legal system by recognizing joint marital property as an instrument of economic justice, prioritizing the best interests of the child in custody disputes, and maintaining guardianship as a mechanism for legal protection and family responsibility. These legal provisions reflect the implementation of maqāṣid al-sharīʿah, particularly the protection of wealth, lineage, and justice, while demonstrating the adaptive nature of Islamic family law in responding to evolving social conditions. The study concludes that the KHI provides a contextual and coherent legal framework capable of harmonizing religious values with national legal objectives. This research contributes to the development of Islamic family law scholarship by offering a comprehensive normative analysis that reinforces the significance of contextual legal interpretation in strengthening justice, legal certainty, and the modernization of Islamic family law in Indonesia.
